Scope of Service & Limitations
WHAT WE PROVIDE
Risky Business Consulting Pty Ltd supplies consultant-written template documents and, where separately engaged, prepares bespoke draft documentation from information supplied by the client. Documents are written by personnel holding relevant Health, Safety, Environment and Quality (HSEQ) qualifications and experience.
WHAT WE DO NOT PROVIDE
We Do Not Conduct Physical Inspections As Part Of A Document Sale
Unless you have separately engaged and paid for a site attendance, such as a building risk assessment, audit or training engagement, no representative of Risky Business Consulting attends your workplace, observes your plant, or inspects your work activities. Documents are prepared remotely.
We Do Not Certify Compliance
No document we issue certifies that any plant, activity, workplace or system of work complies with the model Work Health and Safety (WHS) Act, the WHS Regulations, any Code of Practice, or any Australian Standard. Compliance is determined by the state of your workplace, not by the existence of a document.
We Do Not Provide Legal Advice
Our documents reference legislative duties for context. They are not legal advice and should not be relied upon as such.
We Do Not Assume Your Duties
Purchasing a document does not transfer, reduce, share or discharge any duty you hold under work health and safety legislation.
YOUR OBLIGATIONS BEFORE RELYING ON ANY DOCUMENT
Every document is issued at draft status. Before you rely on it you must:
- Verify every hazard, control and risk rating against the plant, activity or workplace in its actual condition and configuration
- Identify any hazard arising from your specific environment that is not addressed in the document
- Confirm which stated controls are actually in place and functioning
- Consult with the workers who carry out or are affected by the work, in accordance with sections 47 to 49 of the model WHS Act
- Complete every field marked for your completion
- Implement the controls determined to be reasonably practicable
- Approve the document under your own document control arrangements
- Review the document whenever the plant, activity, workplace or legislation changes.
A document that has not been through this process is an unverified draft. It is not a risk assessment, a Safe Work Method Statement or a safety management plan for the purposes of your legal obligations.
ACCURACY OF INFORMATION SUPPLIED
Where we draft a document for you, the document is only as good as the information you give us. You warrant that the information supplied is accurate, complete and current. We accept no liability for a document prepared from information that was inaccurate, incomplete or out of date.
Where we cannot assess a matter from the material supplied, we record it as a stated limitation in the document. Read those limitations. They tell you where the gaps are.
CURRENCY OF DOCUMENTS
A document is current as at its issue date. Any modification, alteration, addition or change of use to the plant, activity or workplace after that date voids the document. Legislation and standards also change. We recommend review at least annually, and immediately upon any change.
LIMITATION OF LIABILITY
To the extent permitted by law, our liability arising from the supply of any document is limited to the resupply of that document or the cost of resupply.
Nothing in this page excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
